Humein ye samajhna chahiye ke kanoon kisi ko bhi "Zor Zabardasti" ki ijazat nahi deta, chahay wo malkiyat ka haq hi kyun na rakhta ho.
1. Punjab Rented Premises Act, 2009 (Common Law for Rental Property)
Ye Punjab ka bunyadi kanoon hai jo residential aur commercial dono tarah ki properties par lagu hota hai. Is act ne purane "Rent Restriction Ordinance 1959" ki jagah li taake faislay jaldi ho sakein.
- Malik-Makan Ke Liye Tahaffuz (Rights of Landlord):
- Kiraya ki Adaigi (Section 13): Agar kirayedar tay-shuda tarikh (aam taur par mahine ki 10 tarikh) tak kiraya ada nahi karta, to Malik-Makan usay bedakhl karne ka kanooni haq rakhta hai.
- Zati Zaroorat (Personal Use): Agar malik ko wo ghar apne liye ya apni aulad ki rihaish ke liye chahiye, to wo aik mahine ka notice de kar Rent Tribunal mein bedakhli ki petition dakhil kar sakta hai.
- Property ka Nuqsan: Agar kirayedar property ki structure ko nuqsan puhanchaye ya us mein malik ki ijazat ke baghair barri tabdeeli kare, to ye kanooni jurm hai.
- Agreement ki Khilaf-warzi: Agar kirayedar ghar ko commercial maqsad (maslan office ya godown) ke liye istemal kare jabke agreement residential tha, to ye fori bedakhli ki bunyad hai.
- Kirayedar Ke Liye Tahaffuz (Rights of Tenant):
- Amenities ki Bandish (Section 12): Malik-Makan kabhi bhi kirayedar ki bijli, pani ya gas band nahi kar sakta, chahay kiraya hi kyun na ruka ho. Agar malik aisa kare, to kirayedar Rent Tribunal se fori "Restoration Order" le sakta hai.
- Ghair-Qanooni Bedakhli: Malik-makan court ke order (Eviction Decree) ke baghair kirayedar ka saman bahar nahi phenk sakta.
- Structural Repairs: Ghar ki chat, deewaron ki mamat aur baray kaam malik ki zimmedari hain. Agar malik nahi karwata, to kirayedar Rent Tribunal ki ijazat se khud karwa kar wo rakam kiraye se kaat sakta hai.

Ye aik sakht criminal law hai jo poore Pakistan mein lagu hai. Iska maqsad "Qabza Mafia" aur un malikan ko rokna hai jo kanoon hath mein lete hain.
- Saza: Agar Malik-Makan kirayedar ko zor-zabardasti, harassment ya darane dhamkane se ghar se nikalta hai, to us par is act ke tehat Sessions Court mein case chalta hai.
- Jurmana aur Qaid: Is jurm mein 10 Saal tak ki qaid aur bhari jurmana ho sakta hai.
- 2026 Update: Naye ordinance ke tehat is act ke cases ka faisla ab 30 se 60 Din ke andar karna lazmi kar diya gaya hai.
LHC ne halia barson mein kirayedar aur malik ke rishtay ko mazeed wazeh kiya hai:
- 2022 LHC 4601 Judgment: Court ne wazeh kiya ke "Due Process of Law" ke baghair kisi ko be-ghar nahi kiya ja sakta. Malik-makan ka kirayedar ke ghar ke bahar hungama karna ya harassment karna kanooni jurm hai.
- DC Evictions Par Rok (2025): Pehle log Deputy Commissioner (DC) ke pas ja kar fori bedakhli karwa lete thay. LHC ne hukum diya hai ke bedakhli sirf aur sirf "Rent Tribunal" ke zariye hogi taake dono parties ko sunna jaye.
- Ownership Challenge (Supreme Court 2026): Supreme Court ne faisla diya hai ke kirayedar jab tak us ghar mein mojood hai, wo apne malik ki malkiyat (Ownership) ko challenge nahi kar sakta. Usay pehle ghar khali karna hoga, phir agar koi dawa hai to civil court jana hoga.

Ye naya kanoon hal hi mein laya gaya hai taake property ke malikan ko tahaffuz mil sakay.
- Summary Trial: Agar koi kirayedar agreement khatam hone ke baad qabza nahi chorta, to malik is naye ordinance ke tehat fast-track case kar sakta hai.
- Special Courts: In cases ke liye makhsoos courts banayi gayi hain jo 30 Din mein faisla sunane ki paband hain.
Islamabad aur baray shehron mein naye rules ke tehat:
- Direct court jane se pehle masla "Mediation Council" ko bheja jata hai.
- Yahan Police aur ilaqa azzez (Elders) baith kar malik aur kirayedar ka samjhauta karwane ki koshish karte hain taake court ke chakkar na lagne parein.
