Pakistan mein aksar private companies "Hire and Fire" ki policy apnati hain, magar qanoonan ye sangeen jurm hai. Agar aap ek permanent mulazim hain aur aap ko baghair notice ya baghair kisi thos wajah (Gross Misconduct ke ilawa) nikala gaya hai, to qanoon aap ki dhaal ban kar khara hai.
1. Aapka Qanooni Haq: Kya Company Aisa Kar Sakti Hai?
Sab se pehle ye samajhna zaroori hai ke qanoon ki nazar mein "Permanent Employee" kaun hai. Har wo shakhs jo 9 mahine ki probation (aatmaishi arsa) mukammal kar chuka ho, wo permanent tasawwur hota hai.
  • Zaroori Notice ka Dorania:
    • Punjab, Sindh, KPK: Kam az kam 30 din (1 mah) ka tahriri notice lazmi hai.

2. Maali Harjana (Financial Compensation): Aap Ko Kya Milna Chahiye?
Agar aap ko nikaal diya gaya hai, to sirf akhri mahine ki salary kafi nahi. Aap darj-zail cheezon ke haqdar hain:
  • A. Notice Pay (Harjana)
    • Agar company ne aap ko 30 din pehle nahi bataya, to unhein aap ko ek mahine ki poori tankwah ba-taur harjana (Pay in lieu of notice) deni hogi.
  • B. Severance Pay ya Gratuity
    • Ye aap ki purani khidmaat ka sila hai. Agar aap ne 6 mah se zyada kaam kiya hai, to har saal ke badle aap ko 30 din ki ujrat (Gross Salary) milegi. Maslan, agar aap ne 5 saal kaam kiya hai, to 5 mahine ki izafi salary aap ka haq hai.
  • C. Leave Encashment
    • Aap ki wo salana chuttiyan (Annual Leaves) jo aap ne istemal nahi keen, un ke badle company aap ko cash ada karne ki paband hai.
  • D. Back Wages (Sab se Aham)
    • Agar aap Labor Court mein case jeet jate hain, to adalat company ko hukum de sakti hai ke jitne mahine aap job se bahar rahe aur mukadma lara, us poore doraniye ki poori salary (Back Wages) ada kare.
